I think we need to separate the case against tobacco and the case against tobacco industry. If a person A pays a person B for a something that ends up hurting a person A that should not be automatically considered a person's B fault. Otherwise virtually no industry is safe.

While it would be nice if the courts would make the distinction - they don't. They are just political entities. No industry is safe but an industry can have some (temporary) security if its politics aligns with the court's.
